Just for the record, the Hamdan case says that it's OK to use military tribunals to try the detainees, which shouldn't be a surprise since the Supreme Court held so long ago, in a couple of cases arising from WWII, most notably Ex Parte Quirin.

Holding that Hamdan isn't a POW as defined by the Geneva Conventions should not be a surprise, either, although I recall butting heads with people about this a couple of years ago.

Doesn't say anything about my argument, that the way they're doing them violates due process. Using evidence the detainee can't see or be told about is probably the worst.
