.If someone yells "fire" in a crowded theater, or other large facility, and someone gets trompled and killed....Is that free speech or murder? Does the person think there is a fire, and is he trying to save lifes? Or is it being done maliciously? That's why we have a legal system. To investigate and either clear the person or prosecute.
