A reporter promises confidentiality, and the paper backs up the journalist because otherwise the public will not learn what it needs to know.

The public is not supposed to know what was revealed here. At that point, the confidentiality of a news source no longer applies. The information in question is not news for public dissemination. In fact, it's the opposite. It's a secret that the public is not supposed to know.

I don't see why the reporter chooses to protect a source for a story she never wrote (if there is no story, is the source still a "news" source?).

Employees who are told they are required to sign waivers to keep their jobs are not sincerely freeing reporters from promises to keep their identities secret. Mr. Cooper said he had gotten a "specific waiver" of confidentiality from Mr. Rove. Ms. Miller says she has not received any such thing from her sources.

I wonder if Ms. Miller's secret source informed her that upon receiving the "confidential information" that she was quite possibility participating in the violation of federal law?

From my understanding this Miller woman is probably a fool for refusing the reveal the perpetrator of a likely criminal action. Conducting criminal activity while under a so-called non-disclosure agreement with a reporter doesn't make it non-criminal, and doesn't absolve the reported from their societal obligation to help solve the crime.
