Somewhere you stated that at the time of adoption of the Constitution, abortion was legal. That, according to numerous sources, is correct. It remained legal through most of the 19th century, then religionist got state legislatures to pass laws outlawing it- -probably because medical advances had made it safer and commoner. My understanding (thread lawyers can correct me if I'm wrong) is that common law rules in the absence of legislated law. Roe v. Wade then becomes simply another case of the USSC overturning laws passed by state legislatures, something within it's accepted powers, and not a case of legislation from the bench. I've got to rethink my previous statements. They appear in error.
