From the time of the Constitution all the way through most of 19th century abortion was legal under common law. What the supreme court did was to overturn state laws that had been infringing on the previous law. I find it amusing that the religious right has been singing the praises of "strict constitutionalists". That phrase means the judge is to interpret the constitution from the vantage point of when it was written rather than what it means to us now. Since abortion was legal at the time of the constitution and remained so for so many years there after, then a "strict constitutionalists" has to side with the pro-choice camp...unless of course he is to play fast and lose with his perspective, which is what the "right" blames liberal judges for.
