Martha Stewart went to jail on four counts of obstructing justice and lying to investigators about a well-timed stock sale. Not for insider trading.

Arthur L Simon promptly filed the required Form 4. If he lies to the Feds about it, then he could go to jail.
Proving he had inside knowledge of the court decision may be difficult.

Simon should have waited until the press release was out. He should be removed from the board. But then so should Schwartz.
