So my husband and I discussed the red light matter last night and could not figure out which one of us was driving. If it was a weekday, no issue, it would be me, but on weekends he does drive my car to the recycle center/solid waste transfer station by I-66. His SUV is brand new and mine is almost ten years old. So we both went to court and told the judge that we did not know which of us was driving, and he dismissed the charge.

FYI, the officer had color photos and definitely the driver ran the light. He told me if I wanted to swear it was my husband the judge would dismiss the case. I told him I couldn't lie but simply did not know.

I assume you also have the right to plead "not guilty" but not sure whether the burden of proof is "beyond a reasonable doubt" (criminal) or "preponderance of the evidence" (civil). No way can they who's driving.
