That's exactly what has happened with ID. I had a good journal article on the subject, but I left it on my intern computer, so it's gone. If you do a search on the history of ID, it'll probably turn up. It's an alliance of creationists of all stripes to get creationism into schools.

The Supreme Court will almost certainly knock it down. Edwards v. Aguillard was pretty clear here. Religion is religion, whether it's couched as philosophy or science, and violates the Establishment Clause. They haven't won a court battle since the Skopes trial, and the TN Supreme Court was so embarrassed they vacated the fine.
