Amkor Tech To Pay Fairchild Semi $3M To Settle Suit

WASHINGTON (Dow Jones)--Amkor Technology Inc. (AMKR) said Wednesday that it has agreed to pay $3 million to Fairchild Semiconductor (FCS) to resolve pending litigation involving allegedly defective epoxy mold compound.

In September 2003, Fairchild Semiconductor filed an amended complaint against Amkor Technology, Sumitomo Bakelite Co. (4203.TO), Sumitomo Plastics America Inc. and Sumitomo Bakelite Singapore Pte. in the Superior Court of California, Santa Clara County.

The amended complaint seeks damages related to Amkor Technology's use of Sumitomo Bakelite's epoxy mold compound in assembling Fairchild Semiconductor's semiconductor packages.

Amkor Technology said Wednesday in a regulatory document filed with the Securities and Exchange Commission that it agreed to the settlement in consideration of a release from all claims against the company related to the litigation.

The Westchester, Pa., provider of semiconductor packaging and test services said the settlement was previously accrued for in its consolidated statement of operations for the first quarter ended March 31.

The company said it will continue to incur legal expenses in defense of its other pending case related to the mold compound litigation matter.

Shares of Amkor Technology recently traded at $5.20, up 13 cents.
