The simple fact is that, under the Constitution, the President has plenary powers to wage war as the Commander in Chief.

Quite wrong. Not at all plenary.

There are statutes which circumscribe the President's authority to use violence and there is, of course, the power of Congress to refuse to fund a war it does not want to see waged.
