I am very familiar with the judge who is handling the Vioxx litigation for the federal courts. I have known him since he was an extremely well-regarded former plaintiff's lawyer. I just favorably concluded a major case with him. Couldn't ask for a better one.

He is not merely competent but is actually superbly so. A scholar, gentleman, and no nonsense jurist who will follow the law wherever it leads without a hint of bias. He will handle the proceedings in New Orleans like they should be handled.

The real problem will be that there will be many Orleans Parish jurors in the jury pool for the first case which starts in November. These jurors will bankrupt Merck in a heartbeat. However, there will also be jurors from other places who are likely to be a lot more conservative. In other words, while the judge will do his best to be fair, the jurors are a complete crapshoot.

It won't be until the lawyers stare into the jurors' eyes that any result can be predicted. Unfortunately, the more educated potential jurors will be the ones which may have formed opinions about the Texas verdict and may be bounced for bias. The ones who don't know anything about it are likely to be the Orleans Parish jurors who won't have the slightest idea what adding seven zeros to a number means.
