Just a cursory look but,

this kind of thing is a problem with the examiner. You have to have good examiners who know their industry. If it's technical, they need to be technically proficient.

Inventions have to be: 1. NOVEL and 2. Unobvious to the practitioners of the art. In other words, if it doesn't meet #2 the patent shouldn't be granted and it can still be kicked out of court.

The invention also has to be an invention. I don't see how a discovery (say of a gene) is an invention but then again I'm not in this field. This is why government sponsored basic research is so important. Without it or, alternatively, profit making potential, who is going to bother?
