I think the argument is backwards. Derivative works makes sense when you're talking about, say, a scientific discovery or an industrial process. These things, however, are figments of someone's imagination. Their use is in their popularity, is anyone arguing for making derivative works of unknown creations?

Therefore, why can't there be brand new figments of the imagination? I see that, and not piggybacking on the success of others, as the true good.

I don't know, I see rehash after rehash of the same works. We're still seeing movies based on works written centuries ago. We're even seeing remakes of old movies.

Can't we do something new?
