it's illegal if he is getting out in front of the trades or someone else is aware of his recommendations prior to broadcast and acts on this information.

I believe cramer had this problem before calling cnbc or taking calls from dave or maria and based on their calls knowing would give them the information out over cnbc he would trade ahead of his statement being released.. i do not think anything was investigated about it thou.
