If we take his argument to its logical conclusion, everything from FDA, FDIC, to every tax credit, deduction, or exclusion on the books would be unconstitutional.

The Federal Spending Clause power is nearly unlimited. It isn't limited to accomplishing the enumerated powers of Art I, and is enhanced by the Necessary and Proper and General Welfare Clauses.

Judge Napolitano knows this, I'm sure. We might not like it, but there we are.
