The Miss AG has a good point, that the storm surge was caused by wind - the hurricane.

The insurance companies, however, have precedent and the english language on their side - that rising water from an ocean, river or lake is not considered "wind driven". The American Heritage Dictionary (1985 ed.) defines "flood" as "an overflowing of water onto land that is normally dry." Right or wrong, that's the traditional definition of "flood" and it doesn't matter what caused the "flood".

One could argue that wind driven water caused the dikes to fail and flood New Orleans, but can one really say that an area 9 ft below sea level is "normally dry"?

Some insurance policies state the policies cover wind driven "rain" as opposed to others that substitute the term "water". That would seem to limit the liability of those that called it "rain" as as storm surge is clearly not "rain".

Do coastal areas qualify for insurance under the Federal Flood Insurance Program? If so, that reinforces the companies' position that everyone understood the coverage terms before the storms.

Interesting from a academic point of view but not for the folks whose involved. While I sympathize with those who lost their homes, especially those of limited means and feel federal loans should be made available to them, do I really want my property insurance to double to pay off someone wealthy enough to build a million dollar vacation home in a vulnerable area, the beach?
