I think in a way you make my point. The problem is perception and the unknown. If you don't know what is going on with the operation of the company, don't even run the risk that someone could claim that you did. Follow the plan I laid out (which is used by execs all over the world) and the question does not come up. Frist just opened himself up for the challenge. If the stock goes up over time, great. If it goes down, fine. You will have dollar cost averaged your way out.

By making one big sale, he just rolled the dice that a similar single event of consequnce (in this case, bad earnings) would occur within a few weeks.

There was a better way to do it. I know Frist said he consulted counsel on all this, but he should fire that lawyer.
