He is was found guilty of trading on information not readily available in the market and gained that knowledge in an illegal way.

IF true there are indeed victums. say I was buying the stock he sold short. If I had the same info he had then I may have not of went long. IE in that scenario the buyer is the victum.

The market operates on the fundamental principle that we all have equal access to the info.

IT deosnt matter how much he made on the information he gained illegally. He Broke the law - The court says so. as far as the penalty phase - well that is once again in the hands of the courts.
