Justices Take Case Disputing U.S. Power Over Private Wetlands

These are the kinds of cases that make it important to have conservative judges on the bench. The regs are usually justified under the Commerce Clause, that the Scalia/Thomas/O'Connor/Rehnquist court was in the process of curtailing. Without that fourth conservative member, we might as well kiss that prospect goodbye again for another decade or two.
