At the time, the right supported it because they said it was the right pragmatic decision, save the democracy, etc. Now, pragmatism be damned, if it's not is the constitution, then it's not an issue for the federal courts. Did the constitution say anything about murder, incest, public nudity, gay marriage, drugs? John
