One difference is that there were natural physical limitations for data on vinyl or cassette

The link below is a very good piece on the dilemma of current IP, written by one of the co-founders of the Electronic Freedom Foundation. The writing is slanted to the position of the EFF of course. The meaty part is the nature and scope of historical copyright protection.

The analogy of selling wine without bottles is very good, IMO.
