While it does take five justices to rule, it does not take five justices to agree on why the decision should be what it ends up being. They can all agree that x is x, and three of the five (or seven, etc.) could write a concurring opinion based on a very different logic or foundation. Using Roe (not Row) as an example, three could decide there is no right to Privacy under Griswald, while two others could believe there is an absolute right to privacy but that it does not extend to abortion. They could base their decision to overturn Roe on something very different...but agree Roe should be overturned. Five votes. The fact that there may be three judges on one theory and two on another does weaken the power of the majority opinion.
Anyway, even though you are wrong some of the time, I don't think you are stupid, idiotic or petty. Disagreement is a wonderful thing. The insults don't add to the quality of the discussion. |
