A few observations on the Nomai affair

My take is this is Nomai's way of trying to get IOM to buy them. Recall that SYQT attempted to buy them a while back until Nomai management took a look at SYQT's books and backed away. Nomai is in a difficult position since their main business (SYQT-compatible cartridges and drives) is clearly dying. They know that IOM's Zip patents are good and that they haven't a legal leg to stand on (France is a GATT signatory and is also bound by EEC laws in addition to having a well-established patent system of its own) but it's an interesting gambit on their part. Remember that patents are only as good as their legal defense and my guess is that IOM's patent team is top notch. When you have an important patent (i.e., one that stands to make you a great deal of money) you are pretty much guaranteed that you'll be spending some of that money defending the patent in court. This is just business as usual, which is why the market doesn't consider it significant.
