That is such an interesting comment. I would think that's exactly what it is. Or rather, it is whatever the current interpretation is at the time. But I don't know how you could ever decide what it IS in some absolute, definitive objective way. You see it filtered through your Tim filters, just as someone else sees it through his own prism. The best we can hope for are judges with sound con law backgrounds and good minds uninfluenced by personal ideology who don't try to stretch penumbra to create new law.

There is a law that teachers and coaches can't lead prayer. Since this man violated it, and then refused to respect the law, the consequences were legitimate. Perhaps the issue will wind up again in the courts and perhaps this time around, the rulings will favor your interpretation. (personally, I am in favor of strict constructionism)
