I believe they agreed to be 'interviewed' by the prosecutors team under the condition they weren't sworn in. Still lying to federal investigators is a crime, or withholding pertinent information is obstruction of justice.

Smart move, that way you are less likely to be in a perjury trap which is supported by a biased judge. You have more than just one legal council available, etc.
