What's relevant is the type of student each institution draws. One needs a 170+ LSAT to get into the top schools, and only 130-140 to get into the ones in the middle of the list. A Rehnquist, who graduated first in his class at Stanford Law, was probably a more excellent student of the law than someone who finished in the middle of the class at an SMU. And if excellence in legal studies is a trait we seek in SC nominees, the top students at the top law schools usually meet that qualification better.
