I have never been in the US on H1-B, but know people who have. 2 I know personally, took the employer to court, and got an "adjustment of status" to L1. Today they are US citizens.

Another person I know, went to court to contest a deportation order. That person is now a US citizen.

Any of these people always had the choice of saying "I'm going back".

This H1B thingammy is a way of grabbing media attention - in real life it does not matter : If a person wants to live here, legally, s/he will find a legal avenue. If not s/he always has the choice to back to their home country. US does not prohibit that.

The loosers in this are the employers : if they mistreat an employee coz of visa status, that employee has many choices to get out. The employer has expended his 1 seat quota for 1 H1B visa for 1 job.
