That is true. But evidence isn't a step function, where you accumulate bits and pieces until it passes some threshold. The bits and pieces in and of themselves are evidence. So the fact that Valerie was classified means she could have been covert, that being a subset of 'classified'. The fact that the CIA asked the DOJ to launch an investigation is pretty strong evidence that she actually was covert at the time, given that they should know her actual status and George Tenet had absolutely no stake in having someone in the administration investigated over something that isn't a crime. So I'd say that bit of information counts as evidence in this case.

Sure, there is more needed to build the case. Which is why Scooter is in hot water. Fitzgerald is convinced he needs Scooter to be candid to figure out what went on and Libby isn't cooperating.
