The majority of people who gamble and probably even a majority of those who buy various forms of "psychic services" are capable of understanding what is happening. Many of them actually do understand what is happening to a fair extent.

Also if you "protect people" by not allowing them to form any contracts because you think they might not understand it than you are treating them as children and limiting their freedom. In the process of doing so you are probably decreasing everyone's freedom. I think legally people should be treated as responsible adults (unless they are children) until they are proven to be incompetent or insane.
