You would have to change many concepts and opinion regarding crimes committed under the influence, specifically regarding "intent" as a necessary element of a crime. No defense of diminished capacity etc should be considered as mitigating the the offense. If you are under the influence or not the crime is still committed and the damage to the people is the same.
