I think you have it completely backwards. The opposition is because of the problems of codifying the idea of never.

I don't think so. "Never" is very easy to specify in law. It only takes one word.

Conversely, specifying Krauthammer's alternative would be very difficult and require pages and pages. Not only do you have to define torture, you have to define "ticking bomb" and "slow fuse." How imminent does the ticking bomb need to be? How many lives at stake? What is the likelihood that the individual has the information? What is the likelihood that you could stop it if you knew his information? You'd use up all your ticking-bomb time allowance just reading the regs, they'd be so long. I've written regs. That one's a non-starter. The war would be over before you could get it promulgated.
