Laws are based on sound and basic principles of right and wrong (like, 'don't steal'). Laws get complicated only because human beings continue to find more and more complex mechanisms to deceive one another in attempts to acquire things they have no legal right to. The judicial function is simply to act in judgement over such matters to determine if a party has crossed the line by interpreting the sound basic principles of right and wrong as they apply to ever changing circumstances.

We have a legislative function to create laws where ever gaps or new needs may exist. It is not the job of judges to try to nudge existing laws to fill gaps or needs. Their role is strictly interpretation.
