Hi Jim - Thank's for the overview on SMLX. I still think Free Speech is the issue and what ever forum is used (as long as there is no fraud) then it is "buyer beware".

I wonder if the SEC treats everybody the same in their overview.

For example, on certain occasions it appears that Novell's prior management was lying to their sharholders regarding channel stuffing. Perhaps it was just not being upfront to the shareholders as to the current state of affairs but at what point should the SEC step in and punish the company and/or BOD and/or management?

Informix is another case in point where 1996/1997 sales had to be restated....no SEC action here.

I guess I want to see a level playing field when it comes to SEC oversight. Too many times management does not clearly state the whole truth when conducting conference calls. Even the 10K and 10Q reports at times are vague on specific company events. These actions are probably not fraud but clearly represent the executive management and BOD business ethics. Maybe this is just an example of 'spin-control' but usually the whole story is not told to the common shareholder.

As an investor, management is the most important criteria for me in investing in a company. However, this can be one of the most difficult items to evaluate. Perhaps the SEC needs to focus on making ALL these companies meet a minimum level of business ethics...no exception.
