Jury Votes Death for Carlie's Killer

After five hours of deliberations, a Florida jury voted 10-2 to recommend the death penalty for Joseph Smith, who abducted 11-year-old Carlie Brucia on videotape then sexually assaulting and killing her on Super Bowl Sunday, 2001.

Circuit Judge Andrew Owens will have to give "great weight" to the jury's recommendation when he officially sentences the 39-year-old Smith next month. Ultimately, the final decision between death and life in prison without parole lies with the judge in Florida.

"I'm overwhelmed. Yes, it's what I wanted," Carlie's mother Susan Schorpen said. "He may be condemned, but he's still breathing, and my daughter is not."

Carlie Brucia's case gained worldwide attention because her Super Bowl Sunday abduction from a car wash parking lot was taped by a surveillance camera and broadcast repeatedly before her body was found.
