Circuit Judge Andrew Owens will have to give "great weight" to the jury's recommendation when he officially sentences the 39-year-old Smith next month. Ultimately, the final decision between death and life in prison without parole lies with the judge in Florida. "I'm overwhelmed. Yes, it's what I wanted," Carlie's mother Susan Schorpen said. "He may be condemned, but he's still breathing, and my daughter is not." Carlie Brucia's case gained worldwide attention because her Super Bowl Sunday abduction from a car wash parking lot was taped by a surveillance camera and broadcast repeatedly before her body was found.
