GRC. A lot of good and valid points. HOWEVER, There most probably will be a hearing where witnesses, Mr Freeney, experts, etc. will testify as to the meaning, prior art, etc. Like you said earlier, THEY (the Defendants) are trying to twist the meaning away from what the obvious definitions are. So .. unrebutted statements of what the claims mean ... at the hearing ....

If they had prior art, they would have disclosed it. GIFT is not worried about Lexis.

Spelling ... should have countered w short statements ... That is not at all a "fatal flaw" regarding the "merits" of this lawsuit.

The lawsuit will be decided "on the merits". GIFT has not "defaulted" by answering the way they did IF they "followed the judges instructions".


Mr Fink- He has more to gain or lose than any one of us, aside from the CEO. He was paid in shares. He comes out w worthless paper if we lose. He reaps millions if we win. He was chosen because of his ability and experience. Mr Freilich still has utmost faith in Mr Fink. When is the Court conference? I think it is this week where we may get a date for the Markman Hearing. Mel
