The Supreme Court has a constitutional role to interpret cases based on that constitution; therefore, deciding whether they have upheld the document will be a matter of opinion for most. If it was crystal clear what to do in every instance, the court wouldn't have to exist.

The President has no such latitude for interpreting the constitution - he has a mandate to carry out its provisions, the laws made by Congress and the decisions rendered by the Supreme Court.

Personally, I disagree strongly with the Kelo case. Absent a true, compelling public use for land, eminent domain should not apply, IMHO. Too many scumbag developers will get in bed with local governments to grab land cheap that they should have paid for at market prices, if they could buy it at all.

I am starting to think I am more libertarian than many on this thread who previously seemed to occupy a place to my right.
