Only in the sense that they have an opinion that in times of war, and we are at war with Al Queda, there are essentially no limits on the powers of the president. Now what is interesting, as noted in this clip, is that they already could wiretap to their hearts content, they just have to ask for a warrant within 72 hours from a body that may have never rejected such a request. But that would require letting someone know about it, which they want to avoid. So they have the NSA, the single most obsessively secret agency in the government, do it, instead of the FBI who has agents that worry about such antiquated ideas like human rights and the Constitution.
