The president has constitutional powers, too. The president does not have the constitutional power to violate the constitution. Bush Jr. doesn't have the smarts and knowledge to know if he could have got authorizaiton via FIST. I'll bet that he could have it within 5 minutes of picking up the phone. He didn't try.
