Learned something you might find interesting. Did you know that if you are an illigal immigrant, before you can get a visa, you have to go back outside the US and wait ten years before you can even apply?

I mention this in the context of "anchor babies." A baby born in the US is considered prima facie evidence that the mother was actually in the US illegally, so it actually works against her. She doesn't get the right to automatically stay, she gets booted, although there are fuzzy areas where you can petition for exceptions based on family being separated.

The child can stay, but who leaves a baby? So if the illegal parent goes back home and takes the baby, the family isn't separated, unless one parent is legal and the other illegal. Then the illegal parent can leave the baby with the legal parent. Not a good option, IMO.

The child can petition for the mother to come, but not until it's 21 years of age.

I have an illegal immigrant client with two American born babies and an illegal husband (father of the babies) so am in a crash course on immigration law.
