There are several problems. The first is a practical one: The FBI, CIA and NSA all hate each others guts. If Bush were a real President, he'd take care of that problem. There is no smooth handing off of intelligence from one agency to another when a foreign suspect enters the USA. That is a disservice to America and someone needs to kick serious butt. Ditto for these agencies talking to local and state authorities, or, as they refer to them, "the rubes." I thought that was what Homeland Security was supposed to do, but they seem to just be a bloated boondoggle.

The second problem is that it is suspicious that Bush would not ask the courts for approval. These are all Republican judges and he would win approval quickly and seamlessly. The fact that he didn't is simply an arrogant Emperor wannabe showing that he has the power and Americans don't. Kind of scary.
