I don't think so. Well, they may be doing that but I think mostly what's being challenged is the notion that, in wartime, the president can unilaterally do whatever he damn well pleases.

I'm not a constitutional scholar. I have formed no conclusion about this.

But I am aghast at the above notion, for one. And for another, I continue to wonder why anyone would do something of questionable legality when there was a legal option available.

Still waiting for more info on both those points.
