A post from Kevin Drum in which he offers an argument that the argument over the NSA intercepts may boil down to a disagreement as to what "wartime" actually means. And, he argues, that debate is an extremely critical one.

I've been thinking that there's an additional distinction that may be at the root of a lot of the disagreement--the differentiation between evidence and intelligence gathering. They're really very different in their purposes and necessarily different in their approaches. This relates to the original disconnect between the left and the right as to whether we use our legal system or military apparatus to deal with prisoners and it's showing up yet again in this issue. People looking at this issue from a justice system perspective see it one way and those looking at it from a war perspective see it another way.
