I've been thinking that there's an additional distinction that may be at the root of a lot of the disagreement--the differentiation between evidence and intelligence gathering.

I'm not certain exactly what you mean here but it reminded me of the post yesterday from wireless worker or wonk about the ease with which the NSA can gather mounds and mounds of digitized data but that they key is how to analyze it. Or, to put it another and more controversial way, "mine the data."

I hope that one of the consequences of these revelations will be to make the whole process more public, more understandable, and more debatable as a question for public decison making.

People looking at this issue from a justice system perspective see it one way and those looking at it from a war perspective see it another way.

While that may be empirically correct, I'm struck by the number of prominent "conservatives" who have publicly expressed serious concerns about this. No doubt there are more who have yet to say something.
