This is a good decision. We can't fight terrorism with the proof standard of beyond a reasonable doubt. So lets find out what the rules are both the bad guys whether US citizens or not.

WASHINGTON - In a sharp rebuke, a federal appeals court denied Wednesday a Bush administration request to transfer terrorism suspect Jose Padilla from military to civilian law enforcement custody.

The three-judge panel of the Richmond-based 4th U.S. Circuit Court of Appeals said bringing criminal charges against Padilla in Florida after he had been held by the U.S. military for more than three years as an enemy combatant created the appearance the government may be attempting to avoid high court review of the controversial case.

The judges also refused the administration’s request to void a September ruling that gave President Bush wide authority to detain “enemy combatants” indefinitely without charges on U.S. soil. Wiping out that ruling would have made it virtually impossible for the Supreme Court to review the case.

All these posts on this thread about WMD or not seem to me superfluous. We know certain facts, We know there was WMD there inventoried by the UN guys in 1997 from there reports and they started to destroy it and then got kicked out. The ISG, both Kay and Deulfer found 22 artillary shells and 1.77 tons of yellowcake. So where is the rest? buried, hidden, moved or destroyed. ISG couldn't say. They could say that Saddam intended to start both Nuclear,chemical and biological again when sanctions removed according to the scientists etc.

So at this point it makes no difference. No WMD chants mean nothing. The issue is what happened to it. Take your pick. Everyone is guessing.
