    Even if Congress had intended to restrict the president's 
ability to obtain intelligence in such circumstances, it
could not have constitutionally done so. The Constitution
designates the president as commander in chief, and
Congress can no more direct his exercise of that authority
than he can direct Congress in the execution of its
constitutional duties. As the FISA court itself noted in
2002, the president has "inherent constitutional authority
to conduct warrantless foreign intelligence surveillance."
A couple of questions/observations come to mind.

How deeply inside the NYT was this story buried (885 words)?

The initial story ran almost two weeks ago (3754 words).
Since then, how many front page articles did the NYT run
smearing the Bush Admin while intentionally failing to once
report any of the information in this story? 10? 15?

How many other stories, opinion pieces, editorials & news
analyses on warrantless wiretaps did the NYT run that also
smeared & slandered the Bush Admin? 50? 75? 100?

Wanna bet this story is used to assert the NYT is fair &
balanced & that they objectively reported all sides of the
story?

Anyone who has followed this story outside of the MSM already
knows that there was no major story there. It was another in a
series of intentional smear jobs that fell flat once all the facts
were known. All the NYT managed was to once again cause real
harm to national security for selectively & deceptively reporting
illegally leaked classified information.
