In this case, I don't think any court will hold for the defendant.

It may backfire on the administration if it pursues this. Going to trial means opening up cans of worms. I don't think any court will like anything the case will reveal with respect to the underlying rationale for the leak.

I vaguely remember Ollie North breaking the law for patriotic reasons. I don't think anything happened to him. But, this time the judicial branch of our government may have a stake in this.
