There is a tension here between the 4th Amendment prohibition regarding search and seizure and the President's inherent power to conduct the war as Commander in Chief. IMO, Bush is not acting illegally because he is exercising his power as CinC to track the enemy and not simply trying to build garden variety criminal charges.... I suspect however that the debate will continue until the USSC decides the issue. J.
