It's not silly. It is at the heart of this issue. We should have secret programs that are known only to a few and have a clearly defined and streamlined authorization process. The FISA court works for both considerations.

It is not enough to tell a few Congressman that you are doing some wiretapping. You need to have a record of what was done, to whom and why. Not so that it can be published daily in a newspaper, but so that the process can be audited at a later date. It is this potential audit that will help to keep people in line. If they know someone might look at a record of their actions they will be more careful. What I will trust them to do is to know when not to be as careful and to stand up and take responsibility for what happens.
