Nope. The issue is the boundary of the President's power to act as CinC. No legislation passed by Congress can impinge on the President's inherent power granted exclusively to the President by the Constitution which is the Supreme Law of the Land. The President asserts that he has acted in a manner consistent with his power as CinC to protect the homeland. The final resolution to the question will most probably have to be decided by the USSC, which body is the ultimate arbiter of the meaning of the Constitution. The legal authorities are split on the issue with prominent legal experts on both sides...
