whether they were under the influence of a substance or not. Laws and Justice are not supposed to be a bunch of "gotcha's". It is supposed to be a system which makes society a better and more reliable place to live. To that end you can't expect justice if all responses are according to a formula, you might as well have a computer instead of a judge. There is also a fairness issue if drugs can be used by the prosecutor to imply irresponsibility, then they should be allowed by the defense for whatever issue they bring to bear. TP
